October 30, 2014, on second reading, MEPs recognized animal quality “of living beings endowed sensitivity” while far the Civil Code considers as “personal property”. June 03, the study group on the protection of animals presented to the National Assembly, a proposal for a more ambitious law.
This status has to change:
To respond to changes in society: For 2 centuries, the relationship between humans and animals have changed. Therefore, our Civil Code can stay away from these social transformations.
In order to defend the animals abused: Although there has emerged in the 20th century a legislative arsenal to protect animals (Rural Code, the Penal Code), complaints often remain closed without follow and penalties remain low or not applied (civil party in nearly 100 trials per year related to acts of maltreatment of animals, the Fondation 30 Millions d’Amis notes that 80% of complaints are now closed without follow). Only a new version of the Civil Code fully recognizing the living and sensitive nature of the animal will push the judges to implement with determination the protective laws for animals. And will offer them a real defense.
